Comprehensive Terms for P2P Donate Platform - Ghana

Welcome to P2P Donate ("we," "our," "us," or "the Platform"), a peer-to-peer donation platform operating in the Republic of Ghana. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and P2P Donate regarding your access to and use of our platform, website, mobile applications, and related services (collectively, the "Service").
By creating an account, accessing, or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Service.
These Terms are governed by the laws of the Republic of Ghana and comply with relevant Ghanaian regulations including the Payment Systems and Services Act 2019 (Act 987), Data Protection Act 2012 (Act 843), and Bank of Ghana guidelines.
Important: The following definitions explain key terms used throughout our legal documents. Understanding these terms is essential for using our platform safely and legally.
A voluntary donation commitment made by a user in one of four fixed categories: GHS 20, GHS 50, GHS 100, or GHS 200. When you make a pledge, you commit to sending this amount to another user via mobile money transfer. Pledges are voluntary donations, not investments or loans.
Our First-In-First-Out (FIFO) system that determines the order in which users receive donations. Users are placed in queue based on when they make their pledge. The system is transparent, and users can see their position. Users at the top may receive up to two consecutive donations before being moved to the back of the queue.
The system design where users who make a pledge may receive donations totaling twice their original pledge amount (e.g., pledge GHS 50, potentially receive GHS 100 total). This is not guaranteed and depends entirely on other users' voluntary participation.
Electronic payment services provided by Ghanaian mobile network operators including MTN Mobile Money, Vodafone Cash, and AirtelTigo Money. All monetary transactions between users occur through these services outside our platform.
Internal digital credits used to pay platform fees. Each pledge requires 10 tokens as a platform fee. Tokens have no cash value outside our platform and are non-refundable. They are used solely for platform operations and maintenance.
The automated process by which our platform connects users who have made pledges with users who are in the receiving queue. Matching is based on pledge categories and queue position, ensuring fair and transparent connections.
The process of confirming that mobile money transactions have been completed between users. This typically involves providing transaction IDs, screenshots, or other proof of payment to demonstrate that a pledge has been fulfilled.
Our internal dispute resolution and customer service system. Users can submit support tickets to report issues, resolve disputes, ask questions, or request assistance with platform-related matters.
The process of confirming user identity and mobile money account details to comply with Ghanaian financial regulations and prevent fraud. May include providing Ghana Card, mobile money account verification, or other identification documents.
P2P Donate staff members who manage platform operations, resolve disputes, monitor compliance, and ensure fair system operation. Admins have the authority to add/remove users from queues and make platform decisions.
A unique reference number generated by mobile money providers (MTN, Vodafone, AirtelTigo) when a transfer is completed. Used as proof of payment and for transaction verification purposes.
Identity verification procedures required by Ghanaian financial regulations to prevent money laundering and fraud. Includes collecting and verifying user personal information, identification documents, and mobile money account details.
First-In-First-Out: The fair queuing principle where users who make pledges first are the first to receive donations. This ensures transparent and equitable treatment of all platform participants.
Age Requirement: You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement with us.
Ghanaian Residency: Our services are primarily designed for residents of Ghana. You must have a valid Ghanaian mobile money account (MTN Mobile Money, Vodafone Cash, or AirtelTigo Money) to participate in the pledge system.
Legal Compliance: You must not be prohibited from using financial services under Ghanaian law or any applicable jurisdiction. You agree to comply with all local, national, and international laws and regulations.
Service Overview: P2P Donate is a peer-to-peer donation platform that facilitates voluntary donations between community members. The platform operates a transparent queue system where users make pledges and receive donations from other community members.
Not an Investment or Gambling Platform: P2P Donate is explicitly NOT:
Voluntary Donation System: All transactions on the platform are voluntary donations between community members. There are no guaranteed returns, and participation is entirely at your own risk.

Platform Fees: A fee of 10 tokens is charged per pledge to maintain platform operations. This fee is separate from any mobile money transaction charges imposed by your mobile network operator.

Maximum Liability: To the fullest extent permitted by Ghanaian law, our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the total amount of platform fees you have paid to us in the 12 months preceding the claim.

Jurisdiction: Any legal disputes shall be resolved in the courts of Ghana, and you consent to the exclusive jurisdiction of Ghanaian courts.
Regulatory Changes: We reserve the right to modify our operations to comply with new or changed Ghanaian financial regulations.
Amendment Process: We may modify these Terms at any time by:
